Nuclear Option To Be Used Over Owens Nomination
BuzzFlash is reporting that Majority Leader Sen. Bill Frist intends to use the so-called "Nuclear Option" over the nomination of Justice Priscilla Owen for the United States Court of Appeals for the Fifth Circuit .
According to reports, Owen frequently makes law from the bench rather than following the intent of the legislature. She demonstrates this especially in her dissenting opinions in cases that involve Texas law which provides for judicial bypass of the parental notification requirements regarding minors seeking abortions. Some of the complaints against her rulings involve her attempting to erect road blocks that did not exist in the statute.
